Branding problem

Hello everyone!

Something happened this afternoon and I wanted to share it because I lost most of it.

I received a call from some people talking about another person trying to register my Company name and that I would lose my Brand since it was not registered, and even worse I would have to pay them to rent over the company name.

They were aggressive and rude asking me to sign a contract in the middle of the afternoon. I had a feeling that they were con artists, that might be the case but I will never know.  

Turns out that besides registering my company name with the government I still have to pay some other department for registering my Brand. Without doing I can lose my brand... this is so dumb, or maybe it was me who never really cared about bureaucracy.

Well, I run and made the register. I don't know if I was fast enough but in case I lose, I will have to find another name for my miniatures. And probably redo a lot of pictures. But I will let you guys know if and when it happens.

Yeah but it's a legal scam. They tell a lie to win a client, at least that's what I believe that they did. I have no way to prove that

I live in Brazil. Yeah, here there is another department to register a Brand. Unfortunately, I did not want to pay for registering my Brand, at the time I felt like this was a waste of money but now that I have many Stores and social media presence, losing this would give me a setback. Yeah, they are doing something close to that on Youtube but to companies (even small ones). A Friend of mine that is a Lawyer is guiding me in the process.

I’m not sure what country you are operating out of, but if its the US you should look into Common Law Trademarks or see if your country has an equivalent. https://www.gerbenlaw.com/blog/an-overview-of-common-law-trademark-rights/ That said, there are people who abuse systems to basically legally scam. This is seen on platforms like youtube with “copyright claimers” who hunt for alleged or actual copyright abuse, report it as if they own it because youtube goes more by algorithm automated claim processing than human operators, then goes to the company asking for a bounty for it. The person may have played ten seconds of a public domain melody then gotten claimed for a Madonna song that is unrelated. Youtube demonetizes them for sometimes weeks while claiming 100% of their ad revenue themselves (which is why youtube does not change the system), plus their place in the recommendation algorithm is permanently damaged. The company sometimes pays out for such fraudulent abuses but do nothing because youtubers having fear of their company is preferable to the copyright bounty hunters not working for them, or even worse if the hunters extort creators leading to someone actually violating copyright being ignored. All above the table activities, the kinda shit you’d see John Oliver covering. Ultimately your brand is essentially that of an artist as far as I am aware, which provides further legal grey area in your favor though I’m not fluent enough in legalese to explain how.

Definitely a scam though not an uncommon one. People will take businesses that are doing well and register their name and then extort them to get the name back. I wish you all the luck in dealing with this issue and hope everything turns out in your favor.
