The description of the mechanics of the adoption of these laws trough court ruling was very illuminating. I had not looked at it through that lens, but that is exactly what happened and continues to happen with abortion in Latin America. A few years ago a legislative attempt to expand abortion access failed in Argentina, the epicenter and vanguard of the movement in Latin America (excluding some smaller countries which already had more liberal abortion policies, such as Uruguay). While it was being debated it became the most salient issue, with society acutely polarized over it, there where huge marches for both sides, every public person was asked to take a side, etc. In the end the attempt failed with something like 45% of the senate votes. Since then the courts in several Latin American Countries have just been ruling that the right to abortion derives from the constitution somehow, this happened in Chile and several Mexican States recently (apparently in Mexico individual state judiciaries have that authority)
