Yeah, this was a weirdly weak take. Especially the part where Matt seemed on board with Lincoln suspending habeas corpus because...it would have been time-consuming for the courts? Why is due process secondary to mere convenience here?

Two issues with Matt’s theory of judicial review: First, it will make genuinely unpopular minorities pretty much defenseless. To take a specific example, the reason criminal procedure became so heavily constitutionalized in the last 70 years is that fairly basic due process rights are unpopular and poorly protected in much of the country, especially for black defendants, and to a large extent that hasn’t changed (as the constant stream of nasty crim pro cases coming out of the Fifth and Eleventh Circuits shows). You might say that federal legislation can solve that, but without functioning federal judicial review, there’s no real check on states doing whatever they want with regard to unpopular minorities even if the feds try to protect them. The overwhelming majority of law enforcement power is controlled by states and there’s only so much spending conditions can do. Second, you need some judicial review for political process protection for your theory to end up in something like democracy. Those combined with your arguments get you limited judicial review just for unpopular minorities and political process stuff. But that’s not necessarily radical or anti-Marbury, that’s been the normie Dem view for almost a century (cf Carolene Products footnote 4). I’m also a judicial review skeptic but I’ve never heard a compelling argument that either is unnecessary.
