I felt really soon that Mr Smiley was not a villain at all, and it made me feel again really weird about the system in place in this universe : they are saying it themselves, his quirk can be dangerous so the guy can be dangerous and he has to be arrested. He's making graffitis out there, and okay it's a vandalism act, but everything they put to catch him was about their egos (not being able to catch him hurt their egos) and "maybe he can use his quirk for real bad stuff".
And see, that's something I've discussed for a long time and I hate a lot : kids are categorized as soon as their quirks appear, as if they can be dangerous for the society or not ; and in a way, this system pushes these kids/people to become villains. And here, Mr Smiley just wanted to make his art, was pushed away by the system on multiple occasions, so he became a vandalist. But never a criminal, he was not hurting anyone.
