He's not testifying to prove Joy said it, he's testifying to prove Joy did it, but his evidence is that she said she did it. So it is hearsay. It's just admissable hearsay. A recording would still be helpful, of course, and he likely has the right to record what's going on in his own office, especially after security has been called for that person, even in a two-party state.

It would be hard to get it kicked on evidentiary procedural grounds, its not even subject to party consent of recording(assuming its a multi-party consent state since we don't have a geographic location of this city) because it *wasn't* a recording.
