Also, why is Kate sitting on the prosecutor side and why did the defense go first. Prosecution present their Case in Chief first then the Defense does.

The most unbelievable part of lost: Kate's trial. Why is Kate being tried in California State Court. What crime did she commit in California? She committed 1st degree murder and felony murder in Iowa (her step-father and her childhood friend while fleeing authorites), assaulted a federal agent. Assaulted a Des Moines police officer when she crashed her car into his. Robbed a bank where she possibly killed several of her accomplices but at the least more assault with a deadly weapon. That was in New Mexico. In Florida, I believe, she assaulted her husband and also committed idenity theft and more fraud there. When she came back, Iowa would probably win extradition, try her for Wayne and her friend's murder. Then the Feds probably would try her for the bank robbery in New Mexico with assaulting a federal agent. Florida probably won't care unless she somehow was found not guilty in those trials. Of course, she did commit a felony in California in this episode when she spoke with her mother. That's witness tampering and witness intimidation. When you're a criminal, even if it's your mother, if that person is a state witness against you, you can't have any contact with them. Her lawyer aided her in that, so he's in big trouble, too. Disbarment and prosecution. And even is her mother did recant, the prosecutor would still put her on the stand and impeach her with her sworn statements to law enforcement when she turned in her daughter. It's the most aggravating thing in the show. Should have just given her a presidential pardon. Oh, she's the big hero of Oceanic Six and here's a pardon.
