Oh and past felonies too if they are less than 10 years old from the date of sentencing release can be entered too if the probative value substantially outweighs the risk of undue prejudice. But since Georgia has no prior felonies they can only talk about past bad acts in general and not any specific instance. So they would have to talk about reputation and stuff in the community only.

2025-07-05 23:25:48 +0000 UTCHi lawyer here again, so the reason why he said “they won’t come after her past” is because under rules of evidence a defendant cannot have prior convictions or past bad acts used against them as character evidence to prove they did this other crime. But there is a few exceptions such as past convictions cannot be used unless they were a crime of fraud or misrepresentation to impeach a witness/defendant (such as saying that she perjured in a prior case and therefore now would also probably lie, or if she had inconsistent statement) and past bad acts cannot be used unless it’s testimony by another witness and to talk about reputation and to show motive, intent, absence of mistake, identity, and common plan. But the evidence of all of the above is subject to this test: the probative value of entering the evidence but substantially outweigh the risk of undue prejudice. Basically, does it affect this case by making something more or less likely to have happened versus does it just make the defendant look bad. Bc past pattern of doing something doesn’t mean you did it again. But also allllll of this can only be used when the defendant opens the door to character evidence by introducing evidence about their character to show they didn’t do it. Or if one of the elements of the crime involves a character element like intent or mental state.
