Police Report:
On Saturday, September 8, 2023, at approximately 0100 hours, Defendant [Redacted] was driving her 2017 Ford Mustang (FL tag [Redacted]) eastbound on [Location Redacted], Broward County, FL, when she left her lane of travel and struck the white lane safety poles. [Redacted] then struck the concrete retaining wall and further struck and knocked down 14 metal sign poles, which landed on [Location Redacted], below [Location Redacted]'s ramp. Five (5) of the lane safety poles were damaged. The Mustang's right front wheel also broke off its hub and fell onto [Location Redacted]. Airbags throughout the vehicle deployed. [Redacted] and her front seat passenger [Redacted] sustained minor injuries from the crash. [Agency Redacted] Fire Rescue responded and transported the passenger to [Medical Facility Redacted] for complaints of back pain (Run #7272). Deputy [Redacted] #12335 and other deputies responded to the scene. Deputy [Redacted] conducted the traffic crash investigation.
Deputy [Redacted] contacted [Redacted], who stated she picked up her friend in [Location Redacted] and was driving her to her house in [Location Redacted]. [Redacted] had the vehicle's key fob on a lanyard on her neck. The vehicle was registered to her, per Teletype. Deputy [Redacted] observed signs of impairment about [Redacted] including unsteadiness on her feet and an odor of alcoholic beverages emanating from her breath during conversation. The DUI Task Force was contacted at 0144 hours and I responded to conduct a DUI investigation.
I arrived on scene at 0159 hours and was informed of the aforementioned by Deputy [Redacted]. I observed the vehicle, the damaged poles, and the scrapes to the concrete retaining wall. I spoke with a [Agency Redacted] supervisor who stated the estimated damage to all the poles was approximately $12,500.00.
I contacted [Redacted], who was seated against the concrete barrier by her vehicle. I introduced myself and made initial observations of her glassy and bloodshot eyes. [Redacted] stated she had a "negative" stomach, which she clarified as being nauseous. I asked her what happened, and she responded, "I’m trying to take my friend home and I hit the side markers." I asked where she was coming from, and she stated from [Location Redacted].
She stated she was picking up [Name Redacted] and going to [Location Redacted]. I asked about who [Name Redacted] was because I was advised her only passenger was [Redacted]. [Redacted] was unsure about her passengers. I asked if she had been drinking, to which she replied she had not had anything. I observed the keys to her vehicle on a lanyard next to her. [Redacted] stated her back hurt but she wanted to stand, which she did on her own. During conversation, I detected an odor of alcoholic beverages emanating from her breath. I informed [Redacted] the crash investigation was completed and I was initiating a DUI investigation. I asked if she would complete roadside sobriety exercises, to which she stated she would.
[Redacted] stated her back hurt but she was okay. She stated she was not diabetic, but she wears glasses, but needs a new prescription. She did not have any other injuries, illnesses, or balance issues, and was feeling healthy. The following exercises were individually explained and demonstrated prior to the start of each exercise. The exercises were conducted and performed on scene:
Horizontal Gaze Nystagmus (6/6): [Redacted] had equal tracking, equal pupil size, and no resting nystagmus in both eyes. She displayed a lack of smooth pursuit in both eyes, a distinct and sustained nystagmus at maximum deviation, and an onset of nystagmus prior to 45 degrees in both eyes. There was no nystagmus observed during the Vertical Nystagmus check.
Walk and Turn (5/8): [Redacted] failed to keep balance while listening to the instructions. She walked forward 10 steps, missed heel to toe on each step, and kept her hands on her hips. She turned around on the line and took 11 steps back, keeping her hands on her hips, missing heel to toe throughout, and stepped off the line once. She did not count her steps out loud.
One Leg Stand (1/4): [Redacted] kept her hands clasped in front of her. She initially did not count, but then began counting as instructed.
Finger to Nose (LRLRRL): [Redacted] touched her nostril then moved her finger to the tip of her nose on the first request. She used the pad of her finger on the 5th and 6th request. She began to use the wrong hand for the fifth request, but stopped, and then proceeded to use the correct hand requested. She needed to be reminded to keep her head tilted back once.
I placed [Redacted] under arrest at 0236 hours and requested a breath test, to which she replied she would. Deputy [Redacted] transported [Redacted] to the [Agency Redacted] Breath Test Facility, with arrival at 0255 hours. BATT [Redacted] #9075 conducted the 20-minute observation. [Redacted] provided valid breath test samples of .124 and .124 at 0331 hours and 0334 hours, respectively. She was read her Miranda Warnings, per [Agency Redacted] prepared form, and she stated she understood and would answer questions. [Redacted] stated she had a margarita at a club around midnight. Photographs of the scene were taken and uploaded to Evidence.com. Deputy [Redacted] completed a DUI Supplemental Report. [Redacted] was transported to [Medical Facility Redacted] for medical clearance and then taken to the [Agency Redacted] Main Jail for further detention. BWC and Patrol Vehicle Dash Cam.
