Probable cause for this arrest is as follows:
On 06/25/2023 at 2002 hours, I responded to a location in [REDACTED], [REDACTED] County, FL, in reference to a crash. Upon my arrival, I observed a white Chevrolet on top of bushes and trees to the right side of the entrance. I also observed a white female in the driver’s seat of the vehicle. I spoke with [REDACTED] who advised that he spoke with a witness of the crash, identified as [REDACTED], who informed him that he observed the female driving the vehicle and exiting the driver’s side after the crash. [REDACTED] also advised that he had completed his crash investigation. I spoke with the driver identified as [REDACTED]. While speaking with the driver at the vehicle, I could smell the odor of an alcoholic beverage. I also observed that she had slurred speech, a flushed face, and watery/glassy eyes.
I asked her to walk with me to the front of [REDACTED]'s patrol vehicle to speak with me, to which she complied. I advised her that we were now conducting a DUI investigation and read her Miranda Warnings. I explained my concerns to her and asked if she would be willing to participate in Standardized Field Sobriety Tasks (SFSTs) to dispel my concern of her possibly operating a motor vehicle while impaired, to which she refused. I again explained my concerns to her, but she continued to talk over me. I asked her several more times if she would be willing to participate in SFSTs, and she again refused. She advised that she did not want to answer any questions at this time. She mentioned that there was a vehicle in front of her that caused her to slam on her brakes. While speaking with her, I could smell the odor of an alcoholic beverage emitting from her breath.
I advised her that I was placing her under arrest for violation of DUI alcohol or drugs. She was handcuffed (double-locked) and transported to the county jail.
Her purse was removed from the vehicle prior to being transported to the jail. Upon searching her purse incident to arrest, I located an old driver's license and a multicolored smaller bag. Inside the multicolored bag was a small clear plastic baggie with a white powdery residue, a cut straw with white powdery residue, and a razor blade. Using a test kit, the straw presumptively tested positive for cocaine. These items were placed into evidence.
Also located inside the purse were several medical marijuana containers with her name on them. These containers were placed into evidence for safekeeping.
At 2148 hours, upon arrival at the jail, the correctional deputies requested she be cleared by the local hospital prior to being booked. She was handcuffed (double-locked) and transported to the hospital.
At 2331 hours, she was cleared from the hospital and transported back to the county jail.
At 2337 hours, we arrived at the county jail. At 2344 hours, I read implied consent to her and requested that she submit to a lawful test of her breath to determine its alcohol content, to which she refused. I read the refusal portion of the implied consent form, and she again refused.
She was issued a DUI citation for violation of DUI alcohol or drugs with a court date of 07/12/2023 at 0830 hours. A refusal affidavit was also completed. She signed and received a copy of the citation. She was additionally charged with possession or use of drug paraphernalia.
