On 03/15/2024 at or around 0057 hours, the Defendant did violate state statutes for refusal of admission and ejection of undesirable guests and for refusal to leave and resisting arrest without violence, while at a local business. While outside the business, in line to enter, the Defendant attempted to talk to her recent ex-boyfriend. The Defendant began following the male around and attempting to grab at his arm, to which he pulled away from her every time. The business security pulled the Defendant and male aside, ultimately not allowing her in the business due to concern of causing a disturbance and interrupting business.
The Defendant was asked multiple times to leave the business by security, to which she refused. Deputies present at the scene advised the Defendant she needed to leave the business property at their request, to which she refused. The general manager informed the Defendant they did not desire to entertain her as a guest and needed to leave the property, as she was causing a disturbance and was intoxicated, to which she refused again. The manager advised he would complete an Affidavit of Complaint, and did so. Deputies attempted to take the Defendant into custody and gave her a verbal command to place her hand behind her back. The Defendant refused and began to pull away. The deputies utilized an open hand control technique to escort the Defendant to the ground. The Defendant continued to pull away and was placed in hand restraints. She continued pulling away while being escorted to the patrol vehicle and during a search incident to arrest. After being placed in a marked patrol unit, the Defendant did not cause further incident.
Court:
Failure to leave after being requested to (Florida Statute 509.141) – a misdemeanor. She entered a plea of nolo contendere (no contest) and was found guilty.
Resisting an officer without violence (Florida Statute 843.02) – a misdemeanor. This charge was nolle prossed (dismissed).
