Kelly's Arrest

Name: Kelly
Arresting Agency: VCSO - VOLUSIA COUNT

Charges

#1 DUI ALCOHOL OR DRUGS 1ST.OFF.

BOND: $1000

Police Report:

In late 2017, during an evening patrol in Volusia County, Florida, law enforcement officers observed a vehicle being driven erratically. The driver, identified as Kelly Marie Flanagan, was suspected of being under the influence of alcohol or drugs. The officers initiated a traffic stop, during which Flanagan exhibited several signs of impairment, including slurred speech, an odor of alcohol, and unsteady movements. Officers conducted a field sobriety test, which Flanagan failed, leading to her arrest for driving under the influence (DUI).

Court:
Legal Proceedings and Plea Agreement:

In the County Court of the Seventh Judicial Circuit in and for Volusia, Florida, Flanagan's case was officially filed under the charge of DUI Alcohol or Drugs (1st offense). However, this charge was later reduced to Reckless Driving.

Plea and Waiver:

Kelly Marie Flanagan, represented by her attorney, entered a plea of nolo contendere (no contest) to the reduced charge of Reckless Driving in violation of Florida Statute No. 316.192. The plea was entered voluntarily, with a full understanding of its significance and the factual basis for it. Flanagan waived her rights to a jury trial, to confront witnesses, and to have the state prove her guilt beyond a reasonable doubt. She also requested to be excused from attending all court proceedings, including the pronouncement of judgment and sentencing. Flanagan confirmed her satisfaction with her attorney's advice and services and acknowledged the potential for enhanced penalties for future offenses and possible administrative actions affecting her driving privileges.

Sentence Imposed:

The court, presided over by a county court judge, approved the plea agreement and imposed the following sentence:

Adjudication Withheld: The court withheld adjudication of guilt for the charge of Reckless Driving.

Probation: Flanagan was placed on probation for six months, with the possibility of early termination upon completion of 50 community service hours. Additionally, half of the community service hours could be converted to a monetary payment of $10 per hour.

Monetary Penalties: A $500 fine was imposed, and Flanagan was required to complete a DUI level one course.

Additional Costs: Flanagan was ordered to pay $50 to the State Attorney’s Office for the cost of prosecution and $50 to the Volusia County Sheriff's Office for the cost of investigation.

Supervision Details:

The probation was to be supervised by Judicial Correction Services (JCS), with a monthly supervision fee of $45. Flanagan was responsible for the costs of any required random drug testing. Alternatively, supervision could be conducted by a correctional services office located in Alachua County, Florida, under the same conditions.

Certification and Execution:

The court's order was officially signed and executed in May 2018. True copies were furnished to Flanagan, and the plea agreement was signed by both the defendant and her attorney, with notarization affirming its authenticity and adherence to legal standards.
