Immediately inform the Pretrial Diversion Program of any anticipated or unanticipated change in your residence or your employment.
Report as directed by your officer. Office, written, verbal, telephonic, and electronic reports may be required as well as associated fees, if applicable. Promptly and truthfully answer all questions directed to you by your officer.
Pay a non-refundable processing and supervisory fee of $50 for each month of supervision to the Pretrial Diversion Program, as required by Florida Statute Section 948.08.
You must pay a $50.00 non-refundable cost of prosecution fee (per case number) to the State of Florida within sixty (60) days as required by Florida Statute Section 938.27.
You must pay a one-time $20.00 Intake fee as directed.
You must pay a one-time $17.00 Drug Testing Fee as directed.
Submit to random urine screenings for drugs and alcohol. Any drug test with a positive result is a violation of this contract, and may result in additional consequences or revocation of this contract.
Special DUI Pretrial Diversion Conditions:
Complete 50 hours of Alternative Community Service (ACS). Unless otherwise directed by Pretrial Diversion staff, all contract conditions must be completed and documentation provided to your PTD officer (or designee) no less than thirty days prior to the termination of this contract or any extension of the contract period.
Attend and successfully complete a DUI Level I School within three (3) months of the date of contract signing unless otherwise directed by your assigned officer.
Comply with any recommended follow-up counseling and complete within nine (9) months of the date of contract signing unless otherwise directed by your assigned officer.
Complete a Victim Impact Class through MADD or Florida Safety Council within four (4) months of the date of contract signing unless otherwise directed by your assigned officer.
Tier I (12 month contracts): Comply with instructions to have either the vehicle driven at the time of the arrest or a vehicle for which your name appears on the title, impounded/immobilized for a period of ten (10) days. The impoundment/immobilization is to occur between the first day of the sixth month and the first day of the eighth month.
OR
Tier II (15 month contracts): Comply with instructions to have installed in any vehicle you operate an approved ignition interlock device for a period of six months. The device must be installed no later than the third month after the contract is signed unless otherwise directed by your assigned officer.
Make a $1000 monetary donation to a designated non-profit agency approved by the Office of the State Attorney. The donation is to be made within nine (9) months of the date of contract signing, and proof of the donation is to be submitted to the Community Corrections Division or as instructed by your officer.
You must pay cost of investigation in the amount of $152.00 + $43.16 / cost of restitution $0.
