Police Report:
On Monday November 14, 2022 at approximately 0019 hours, I was observing the 4-way intersection at Greek Park Drive with Aquarius Agora Dr when I observed a Grey Honda bearing the Florida tag ****, make no attempt to stop at the stop sign, and continue east towards Centaurus Blvd. I initiated a traffic stop utilizing my vehicle's emergency lights. The vehicle came to a stop in front of the Performing arts center.
I approached through the right passenger's side of the vehicle and introduced myself to the sole occupant of the vehicle. I immediately smelled the odor of alcoholic impurities emanating from the vehicle. I explained the reason for the stop to the driver and asked her to provide her Driver's license and the vehicle's registration. The driver, who was identified by her Florida driver's license as Kaitlyn **** , was slow to respond to what I was saying, had slurred speech, and was extremely apologetic. Kaitlyn handed me her license, and had to be reminded to provide her registration. I asked Kaitlyn where she was coming from. Kaitlyn replied she was just leaving a sorority house. I asked Kaitlyn if she had anything to drink tonight. Kaitlyn stated she would be honest, and stated she had 'enough' to drink tonight. I asked Kaitlyn to step out of her vehicle and come talk to me at my vehicle. Kaitlyn had an orbital sway front to back, and left to right. I was able to isolate the odor of alcoholic impurities coming from her breath. Kaitlyn's eyes were bloodshot and watery.
Based on the totality of the circumstances thus far, I asked Kaitlyn if she would participate in standardized field sobriety exercises (SFSE's) in order to dispel my fear that she was operating a vehicle in the State of Florida, County of ****, and in the jurisdictional limits of the University of Central Florida while her normal faculties were impaired by a chemical or controlled substance, to which Kaitlyn agreed. While asking for her to perform SFSE's, Kaitlyn began to cry hysterically, sobbing that she was sorry and that she knows she made a mistake. Kaitlyn then spontaneously uttered "just go ahead, take me to jail. I messed up'' and "I should have never drunk drive. And you can arrest me for that. I asked if Kaitlyn was saying she was drunk. Kaitlyn replied she was a little bit drunk. Kaitlyn also spontaneously uttered that she deserves to go to jail.
Kaitlyn stated she is not wearing contacts, not diabetic, and does not take insulin. Kaitlyn does have a kidney infection that began from a UTI, however she was never diagnosed by a doctor, is taking cranberry pills for it, and it does not affect her driving. Kaitlyn continuously stated she is 22 years old (she is 23). She is not under the care of a doctor or dentist, has no physical disabilities, no speech impediment, not injured, no glass eye or artificial limbs, no physical or head injuries. Kaitlyn ate recently and had 12 hours of sleep last night. Kaitlyn has no mechanical problems with her vehicle. When I asked Kaitlyn what time she believes it was, she replied it was around 11 PM (it was currently approximately 0029 hours). I asked Kaitlyn what she had to drink tonight. Kaitlyn stated she had 2 martinis. Originally, Kaitlyn stated she started drinking at 8 PM, but when I asked when she drank her last drink, Kaitlyn changed the times to 7 PM her first drink, and she stopped drinking at 11:30 PM.
Horizontal Gaze Nystagmus: Kaitlyn had no resting nystagmus, had equal pupil sizes, and equal tracking. I observed a lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes, and onset of nystagmus prior to 45 degrees in both eyes. I did not observe vertical gaze nystagmus. I had to remind Kaitlyn to keep her head still during the exercise. I had to ask Kaitlyn to hold
I used a yellow tape line on the sidewalk, placed by Ofc. Sienkiewicz, for the walk and turn. I asked Kaitlyn if the line looked level, straight, free of debris, dry, and had no big bumps or ridges. Kaitlyn replied that the line was good. I asked Kaitlyn if she felt comfortable in her shoes. Kaitlyn stated she was. Ofc. Sienkiewicz told Kaitlyn that her shoe was untied, and reminded her to tie it.
While explaining the instructions, Kaitlyn could not keep her balance while listening to instructions, and would step out of the starting position with both feet multiple times. Kaitlyn uttered again "I can't do it, just take me to jail". Kaitlyn was unable to stay in the starting position for longer than a couple of seconds without raising her hands. Kaitlyn repeated multiple times before I finished reading the instructions that she can't do the exercise, even mentioning that she couldn't even hold the starting position. For Kaitlyn's safety, I asked for her to stand normally while I finished the instructions.
After finishing the instructions, Kaitlyn continuously would get into the starting position, step out, and say she couldn't do it because she would fall. I asked her one last time if she would do the exercise, and to reply with a yes or no. Kaitlyn stated no, she couldn't do it because she would fall over, and began to sob again. Because Kaitlyn was still crying I offered one more time for her to attempt the exercise. Again, she stated she could not do it. I ended the exercise for Kaitlyn's safety.
One Leg Stand: The exercise was performed in the same area as the walk and turn (level, free of debris, dry). While explaining the instructions, Kaitlyn would attempt to lift her leg, raise her arms up, and would drop the foot immediately. Kaitlyn stated she couldn't do the exercise. When Kaitlyn was able to stop crying, I asked if she was ready. Kaitlyn nodded no. I ended the exercise for Kaitlyn's safety.
Post arrest: Based on Kaitlyn's driving pattern, personal contact and performance of the exercises, I determined that her normal faculties were impaired while operating a motor vehicle. Based on the totality of the circumstances, I placed Kaitlyn under arrest for the offense of driving under the influence. I placed Kaitlyn in handcuffs, checked them for fit, and double locked them. Kaitlyn repeatedly asked for officers to call her uncle.
Kaitlyn was transported to the Orange County DUI Center. Upon arrival, Kaitlyn was placed under a twenty-minute observation. At the conclusion of the observation, I requested she submit a test of her breath. Kaitlyn provided two samples resulting in .219 BrAC and .235 BrAC. Kaitlyn was given a DUI citation *** and a UTC for FS 316.123(2)(a) - failure to stop at a stop sign ***.
Kaitlyn was transported to the Orange County Jail without further incident. Kaitlyn's vehicle was towed by **** Towing.
