ATF Update: More Transferrable MGs and One-Week NFA Transfers (Ad-free)

Two pieces of surprisingly good news regarding the NFA :

First, ATF has recognized that about 4,000 machine guns imported prior to 1986 for police agencies were mis-classified as dealer samples when they should have been fully transferrable. Those guns are being reclassified as transferrable now, and lots of dealers have already probably noticed the change. We are still waiting on written confirmation from ATF, but this has been a project years in the making between NFATCA and the ATF, and it has finally come to fruition.

Second, with some changes to their internal processes and fully exploitation of the eForms digital system, processing waits for Form 4 transfers (ie, transfers to individuals) are down to one week or less. This assumes that someone uses the electronic eForms system with digital fingerprints and pays the tax stamp electronically as well, and that there are no errors on the form. Given those conditions, the previous standard of +/- 9 excruciating months is now down to a few days.

Would it be better for the NFA to be repealed entirely? Yep, but I will take incremental improvements in the meantime!

It would be nice if the New York City Police Dept. , Licensing Division/Section would also speed up it's processing times. As a city permit holder I have to wait over 90 days to obtain a Purchase Authorization to add a weapon to my License . I have been told that it may take close to 180 Days to get an approval to buy a new pistol for a license holder. This is a total shame. I believe it is only done to punish and frustrate License Holders ! Not to prevent Gun Crimes as the City say's !

Yeah, I think most of these "machine guns" are probably MP5s since it was the hot new thing for police departments before the end of the registry in 1986.

My first ever Form 4 individual trust took 72 .gov hours (weekend excluded) via Silencer Shop two weeks ago. YMMV of course. Now to punt the NFA to the legal trash bin of history….

I have to constantly remind myself that "machine gun" means "device capable of allowing automatic fire" for the ATF. Otherwise, I was a bit weirded out for the excitement, until I remember an MP5 and HK full auto trigger pack are machine guns lol.

I filed a form1 as a trust on Sunday (eFile, digital prints, with a 24 mo exception letter in leu of trust documents, 2 responsible persons), and got it back this morning (tuesday). most of my other form 1's have taken 20-60 days, so this is much faster as well.
