Azkaban is definitely posed as a fate worse than death and if anything it seems to make people more inclined to damage their soul by killing others because they don’t feel they have anything to lose after being there…

I absolutely think the MACUSA is pro death penalty. And honestly, given the emphasis placed on souls in the wizarding world, I would prefer their method to Britain’s MoM’s method.

Like even if he DOES take the potion 🧪, he still transforms & “just curls up in his office, a harmless wolf 🐺” … in Lupin’s own words … Are you saying that he won’t transform because of the “not-seeing the moon 🌕 thing” in the book?? I don’t think that really applies here because even BEFORE the inventing of the potion 🧪, Lupin just stayed TRANSFORMED in the Shack during his school days … 🤔
