The problem with Copyright...

UMG have said they have reviewed my Johnny cash video and deemed it not to be fair use. The problem is no one has actually viewed it, they have made that decision without seeing it. I can tell this as the views of the video sit at 0. This goes against copyright law where copyright claims must be made in good faith. How can this be good faith where they haven't even seen the content? Obviously I can't take UMG to court as I don't have the money, so they will most likely eventually win...

Thanks Derek. I’m pretty good with the system now and I’ve actually pushed it further than Knox has. I’ve initiated legal action twice and won both so far. The issue is more you can only fight two at a time without losing the channel. I could fight more and win, but would have no channel left at the end of it! Youtube have it set up as a very flawed system.

No they don’t need to at this point as YouTube will do the block / takedown before there is any legal action taking place. When I do the final appeal (which still goes straight to the copyright holder who has already rejected it) I have to give my personal name and address as that starts a legal process at that point. But if that appeal gets rejected I then get the strike and the takedown notice. I then have to start formal legal action to get the strike removed and that goes through my countries court system and UMG will instruct here. I could theoretically take UMG to court now as I have evidence that they have falsified their claim by saying my content doesn’t fall under fair use - it’s falsified because they haven’t actually reviewed my footage to be able to review my claim. The biggest issue with all of this is you get the strikes without anyone independent of the copyright holder actually reviewing it. If you get three strikes the channel is terminated. If you get one strike and win the court process then the strike gets removed, so you can only really fight one at a time otherwise you run the risk of having 3 strikes at one time. This is why reactors start panicking at strikes.

Yeah that makes sense, do you know if any of the claims have specified your region/country?

There isn’t really a way around it, that’s why so many channels either give up or get big enough that they can deal with the labels direct. It’s also why quite a few live stream off platform (such as on twitch) and then delete the video or cut it down straight after as they get donations during the stream instead of relying on ad revenue from the video itself.

Yeah that truly is just aggravating, sorry you have to deal with all of these "policies" that dont even hold everyone to the same standard. i'll try to find some other ways to work around it

That usually clears the video copyright. Then there’s the audio copyright too. Sometimes they are held by the same copyright holders, sometimes they are different. But both still have to be disputed. That’s why if you watch some reactors they heavily edit the actual audio too. The Johnny cash one shows as audio and visual claim, so even with the video missing it will still get picked up with the audio.

I think this is a good method to try maybe From Heather Armstead "I see a lot of reactors put filters over the top of videos and flip them horizontally, is it worth trying that?" I've seen people blurr the image of the video which should help with the video itself being detected and blocked. i dont recommend editing the audio by upping the pitch as it may affect views and overall enjoyment of watching. but if blurring doesnt work then if necessary as a stopgap it should work for uploading the video atleast.

I really don't know what else to suggest :( I think you should do a video guaranteed not to get a strike* and at the start tell everyone how much aggro you're getting with copyright, and stress that there's loads of videos on your patreon, so people should sign up! *Voiceplay never copyright strike people, how about doing their cover of Creep, it fits your niche/brand and will go out without issues to get the message out fast?

A lot of smaller reactors seem to be shutting down their channels because of all this. The larger ones that have a million plus subs I would imagine have something in place with the record labels to get past this.

I know right. Pretty much every video I post is like this and I have to fight them. With this one I now have to appeal that decision and my appeal goes straight back to UMG for them to decide again. Inevitably they will stick to their original decision and I'll get a copyright strike (3 strikes and you lose the channel). I then have to start legal proceedings against UMG to get the strike removed. We then hope at that point UMG decide not to go to court with me and then the strike gets taken off. But that whole process takes up to 60 days. This is why some of my reactions look really old when they get released as I literally did them months ago.
